Gibson Dunn's May 27, 2026 note on the AI Act omnibus agreement says stand-alone Annex III high-risk obligations are deferred to 2 December 2027 and AI embedded in regulated products under Annex I to 2 August 2028. It says a new Article 5 prohibition on AI-generated non-consensual intimate imagery and child sexual abuse material is added, with a transitional period to 2 December 2026, and that the Article 50 transparency obligations largely stay on their 2 August 2026 date.
Morgan Lewis reported on June 24, 2026 that the EU approved the delays and amendments. Gibson Dunn's timeline table lists the general-purpose AI model obligations as applying from 2 August 2025, and says the omnibus agreement reinforces the AI Office's enforcement powers and gives it exclusive competence over AI systems built on a general-purpose model by the same provider.
The December 2027 postponement for high-risk systems and the December 2 date for the new prohibition match the sources. The 'high-risk' postponement covers stand-alone Annex III systems. Systems embedded in regulated products are deferred to August 2028, which the note does not mention.
The note says general-purpose model rules became enforceable on August 2, 2026. The sources read here say the model obligations have applied since 2 August 2025 and that the omnibus reinforces the AI Office's enforcement powers. Whether the Commission's enforcement and fining powers over those models start on August 2, 2026 is not stated in the pages read, so that date is unsupported here, not refuted.
The line that the most regulated thing in Europe is the model and not the use case is the author's reading. The sources describe a model-level regime already in place alongside a postponed use-case regime, and they do not rank regulatory weight.
